Client terms
Introduction
We are Jaderberg Krais Tutoring Limited, trading as “Dukes Tutoring”, a company registered in England & Wales under number 7220306. Our registered office is at 58 Buckingham Gate, London, SW1E 6AJ.
Interpretation
In these terms the following words have the meaning set out below:
Client – Anyone who purchases a product or service from Dukes Tutoring either via the website, www.dukestutoring.com, email, telephone or in person, referred to as ‘you’ in these terms.
Engagement – engagement (direct or indirect) between the Client and Tutor, arranged as a Schedule of Lessons or other tuition services agreed between you and your Tutor.
Lesson – a single Lesson provided by your Tutor under these terms.
Schedule – a schedule is an agreed timetable of Lessons, specifying frequency, length, start and end date.
Tutor – a tutor delivering Lessons on behalf of Dukes Tutoring.
References to ‘us’, or ‘we’, or ‘our’ are references to Jaderberg Krais Tutoring Limited, hereafter ‘Dukes Tutoring’.
Engagement with Dukes Tutoring
Arranging Lessons and Paying Fees
Fees for trial Lessons are payable in advance. Where a Lesson is cancelled by you with less than 24 hours’ notice, we reserve the right to charge the full fee in regard to the scheduled Lesson. Hourly tuition is paid in arrears on a monthly basis, according to your Tutor’s hourly fee rate and the length of the Lesson. Fees are payable within 7 days of presentation of the invoice. Dukes Tutoring will notify you of the applicable hourly fee rate for the confirmed Tutor. We reserve the right to change the hourly fee rate for our Tutors, but we will provide notice in advance of agreed Lessons. When a package of tuition Lesson is purchased, additional Lessons or packages must be agreed with Dukes Tutoring in advance; we will confirm additional Lessons with your Tutor.
You may be required to pay a deposit in advance of any Lessons being provided, which will be held by Dukes Tutoring and applied against our final invoice for tuition fees when our Engagement is terminated. A deposit is normally equal to one month’s tuition fees or such other amount as shall be advised by Dukes Tutoring.
If you fail to make any payment, other than invoices cancelled according to these terms, Dukes Tutoring may apply interest on the overdue amount at a rate of 8% per annum above Barclays Bank plc’s base rate from time to time. Such interest shall accrue on a daily basis from the due date until actual payment of the overdue amount, where before or after judgement. We reserve the right to pause delivery of tuition if we have not received payment for an invoice or deposit.
Study Environment
For tuition taking place at your home, you will ensure that your Tutor is provided with a safe, quiet teaching environment appropriate for study, in a communal area. Tuition cannot take place in a private area such as the student’s bedroom. An appropriate and responsible adult should also be at the premises for the duration of each Lesson. You must inform us and your Tutor if there are any building works occurring or animals that your Tutor may have contact with, in advance of scheduled Lessons.
Terminating Lessons
You may terminate a Schedule of Lessons at any time by providing one month’s written notice.
Although we endeavour to provide consistency for our students, and typically have long-standing relationships with our Tutors, there are occasions where a Tutor becomes unavailable during a Schedule of Lessons. In this situation, we will agree a different, suitable Tutor with you.
If you supply false or misleading information to us, or are abusive or offensive to any member of our staff, Tutor, or other Client, we reserve the right to terminate our engagement with you.
Non-Engagement of Tutors Following Termination
By engaging with Dukes Tutoring, and receiving introductions to our Tutors, you agree not to engage directly with any Tutor, for at least 12 months following termination of Lessons with Dukes Tutoring. Dukes Tutoring reserves the right to charge a conversion fee of £1,500 if you directly engage a Tutor directly who has been introduced to you by Dukes Tutoring, within 12 months following termination of Lessons with Dukes Tutoring. You agree not to introduce Dukes Tutoring’s Tutors to others for the purposes of tuition.
Other Rules
The Client will not share confidential information about Dukes Tutoring or its Tutors with any person, except as required by law.
Student Rules and Conduct
Students receiving services from Dukes Tutoring agree to comply with our health and safety rules and our course rules (as listed below). The breach of any course rule stated below may result in dismissal from the course, event, package, or programme, without refund of the fee. Furthermore, any student who breaks the law or displays aggressive, intimidating or racist behaviour will face instant dismissal. Should a student face instant dismissal, the student will be withdrawn from the course with immediate effect. No refund will be made on the fee.

- All damage to property, equipment and rooms will be charged to the Client instructing services for the student.
- Gratuitous or wilful damage, theft or suspected theft of school or college property, public property or other students’ property may result in dismissal from the course.
- Consumption or possession of alcohol by students of any age is not permitted and will result in dismissal from the course.
- Drug-taking or possession of drugs including Psychoactive Substances (in the UK formally known as legal highs) will result in instant dismissal from the course.
- Smoking, e-cigarette smoking, and vaping is not permitted by any student under the age of 18 and will result in instant dismissal from the course.
- Racist or intimidating behaviour towards another student or member of staff will result in dismissal from the course.
- Students are expected to attend all classes provided on time unless agreed in advance with a member of Dukes Tutoring staff.
- Should a student wish to leave a course or event early, a parent or guardian must give their consent for this in writing.
- Personal mobile phones should be turned off during all Lessons and scheduled activities unless otherwise instructed.
- Students and parents should not attempt to discover or contact the personal email addresses or social media accounts of staff or tutors.
- Where courses are held virtually (online), students should not have their session in an intimate, closed setting, such as their personal bedroom, they should be in a communal area of their home or school and should keep a blurred or neutral background.
Our Refund & Cancellation Policy
Clients agree to adhere to the following refund and cancellation policy.
In the following, working days are considered to be Monday-Friday 9am-5pm, except for bank holidays in England.
Private Consultations
If a Client wishes to cancel a Private Consultation, they must give Dukes Tutoring at least 24 hours’ notice, otherwise the full fee will be incurred by the Client.
The Premier Service
Please refer to separate terms and conditions, as outlined in the Premier Service contract that each Client signs on initiation of the Premier Service programme.
Mock Tests and Educational Materials
On receipt of a digital copy of our educational materials or mock test booklets, or through access via our virtual learning environment, that purchase is non-refundable.
Hourly Tuition
Scheduled Lessons require 24 hours’ notice of cancellation, otherwise the full fee will be incurred by the Client.
Termly Tuition
Discounted packages of tuition, scheduled for a half term or term, are refundable only before the Tutor has been introduced to the Client. Following introduction, the package is non-refundable.
Schools Programmes
Unless separate terms are agreed in writing, school Clients must provide more than a half term’s notice for terminating a class earlier than the agreed end date. If a Client wishes to cancel a specific Lesson, they must provide two working days’ notice to avoid being charged.
Refunds will be processed within 14 days of being received.

Dukes Tutoring is a tuition and educational advisory service. The information and preparation we offer should be taken in that context. We cannot guarantee an applicant achieves a particular educational target, test score, school place, university place or outcome. As such, Dukes Tutoring is not liable for any student’s educational outcome. Although we strive to ensure the accuracy of our information, we cannot guarantee it and Dukes Tutoring accepts no liability whatsoever if the information it provides proves to be incorrect or if the student acts differently to how they would have acted without the services of Dukes Tutoring. Your statutory rights are unaffected.

Other Provisions
Any amendment to these terms shall not be effective unless agreed with Dukes Tutoring in writing.
If any provision of this is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms.
Enforcement of these terms is subject to English law. These terms shall not exclude or limit our liability for death or personal injury caused by our negligence. Nothing in these terms limits or excludes your Tutor’s liability for any liability which cannot be limited or excluded by applicable law.
These terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
